Abstract
Změna pohlaví úzce souvisí s mnoha právními obory, byť je často spojována pouze se zdravotnickým právem a lidskými právy. To je však zcela nedostačující. Ostatně jak stanoví § 29 odst. 2 občanského zákoníku, tak změna pohlaví souvisí mj. i s rodinným právem. S ohledem na rozšiřování povědomí o problematice změně pohlaví je nutné určit i její souvislosti s širokou paletou právních oborů. Proto tento článek nabízí základní náhled do souvislostí změny pohlaví s právem rodinným a problematikou registrovaného partnerství. Není přitom opomenuta ani problematika výživného mezi transsexuálním rodičem a jeho dětmi, ale i naplňování výkonu rodičovské odpovědnosti ve smyslu § 855 a násl. občanského zákoníku.
Gender reassingment is closely related to many legal fields, although it is often associated only with healthcare law and human rights. However, this is entirely inadequate. Moreover, as stipulated in Section 29 paragraph 2 of the Civil Code, gender reassingment is also connected, among other things, with family law. Considering the increasing awareness of gender change issues, it is necessary to identify its connections with a wide range of legal disciplines. Therefore, this article provides a basic insight into the connections between gender reassingment and family law, as well as the issues surrounding registered partnerships. The article also addresses the matter of alimony between a transgender parent and their children, as well as the fulfillment of parental responsibility as defined in Section 855 and subsequent sections of the Civil Code.
