dc.description.abstractPředmětem této diplomové práce je pojednat o problematice konsensuálních kontraktů a jejich úpravě v římském právu. Cílem je popsat jednotlivé typy konsensuálních kontraktů z pohledu římských právníků. Práce se nejprve věnuje obligačnímu právu, dále je zaměřena na třídění obligací a konkrétněji na téma kontraktů. Detailně poté jsou zpracovány kontrakty konsensuální jednotlivě - emptio venditio, locatio conductio, societas, mandatum. V závěrečné části práce je zdůrazněn význam římského práva pro současnou právní úpravu a vybrané instituty římského práva porovnány se současnou úpravou a novým občanským zákoníkem.cs
dc.description.abstract-translatedThe object of this thesis is to discuss the issue of consensual contracts and their treatment in Roman law. The aim is to describe the different types of consensual contracts from the perspective of the Roman lawyers. First, we discuss in general the bond law, than it is focused on sorting of bonds and more specifically on the subject of contracts. Then consensual contracts are processed individually in more details - emptio venditio, locatio conductio, societas, mandatum. In the final part of the thesis, there is emphasized the importance of Roman law to current legislation and selected institutes of Roman law are compared with current treatment and the new Civil Code.en
