| dc.description.abstract | Rigorózní práce se zabývá problematickou vazby v trestním řízení se zaměřením na její materiální předpoklady. První kapitola podává historický exkurz do problematiky materiálních předpokladů vazby. Druhá kapitola specifikuje vazbu obecně jako zajišťovací institut a její zakotvení v ústavněprávní, mezinárodní i zákonné úpravě. Dále jsou zde zahrnuty základní zásady aplikace vazby. Následující dvě kapitoly jsou věnovány podrobnému rozboru materiálních předpokladů vazby v podobě obecných předpokladů, konkrétních důvodů vazby včetně kvalifikovaných důvodů vazby a dále rozboru institutů nahrazujících vazbu. Podkladem pro zpracování je nejen dostupná literatura, ale i bohatá judikatura Ústavního soudu ČR a Evropského soudu pro lidská práva. Pátá kapitola se zabývá materiálními předpoklady vazby ve věcech mladistvých, které obsahují určitá specifika od vazby dospělých osob. Následující kapitola nabízí srovnání se slovenskou právní úpravou, kde lze nalézt některé odlišnosti a také inspiraci pro naši úpravu. Závěrečná kapitola je věnována úvahám de lege ferenda. | cs |
| dc.description.abstract-translated | The rigorous thesis deals with the custody in the criminal proceeding with a focus on its material assumptions. The first chapter offers the excursion into the history of this problematics. The second chapter specifies the custody as a hedging institute and its inclusion in constitutional law, international law and statutory regulation. There are also included the basic principles of the custody application. Following two chapters analyze in details material assumptions of custody and describe all general material conditions for custody, the reasons for custody including also the qualified reasons for custody and the custody-substituting institutes. The analysis is based on the available literature and also on the rich judicature of the Constitutional Court of the Czech Republic and the European Human Rights Court. The fifth chapter deals with the material assumptions of custody relating to adolescents, which contain some specifics from the custody of adults. In the conclusion the thesis offers comparison to the Slovak legislation on the subject and de lege ferenda considerations. | en |
