dc.description.abstract-translatedDetention decisions constitute a significant interference with the presumption of innocence and the individual’s personal liberty. Consequently, there is a duty to provide adequate reasoning for such decisions, as they fall within the broader framework of the right to a fair trial under Article 6 of the Convention. Besides this duty, Article 5 (the right to liberty) also establishes requirements for reasoning in detention decisions. The general duty to provide reasoning serves to clarify the grounds and rationale behind the decision. However, the requirements derived from Article 5 of the Convention expand this duty to some extent, aiming to prevent arbitrary deprivation of liberty. Based on the consistent case law of the European Court of Human Rights, a detention decision should comply with the law, the legal provision on which the decision is based must be specified, an individual assessment of the facts must be conducted, and it must be considered whether such a measure is proportionate.en
