dc.description.abstractPředkládaná rigorózní práce se zabývá nenávistnými projevy na internetu jako součástí skupiny trestných činů z nenávisti. Cílem této práce je zjištění, za jakých podmínek je nenávistný projev trestným činem a současně podání uceleného výkladu k tomuto tématu v souvislostech de lege lata v rámci právního oboru trestního práva. Práce analyzuje i některá soudní rozhodnutí, a to jak rozhodnutí soudu České republiky, tak Evropského soudu pro lidská práva. Součástí je také pojednání o právní úpravě v Spolkové republice Německo. V závěru práce jsou formulovány určité návrhy de lege ferenda a jsou shrnuty analyzované podmínky, za kterých by nenávistný projev na internetu již mohl být trestným činem.cs
dc.description.abstract-translatedThe present thesis deals with hate speech on the Internet as part of hate crimes. The aim of this thesis is to determine under what conditions hate speech is a criminal offence and at the same time to provide a comprehensive interpretation of this topic in a de lege lata context within the legal field of criminal law. The thesis also analyses some judicial decisions, both those of the Czech Court and the European Court of Human Rights. It also includes a discussion of the legislation in the Federal Republic of Germany. The thesis concludes with some de lege ferenda proposals and summarises the analyzed conditions under which hate speech on the Internet could already be a criminal offence.en
