| dc.description.abstract | Předkládaná rigorózní práce nesoucí název Hmotněprávní základy shromažďovacího práva v ČR si stanovila za cíl analyzovat, rozebrat a zhodnotit stávající právní úpravu a upozornit na aplikační problémy. Jelikož shromažďovací právo dle mého názoru náleží k nejvýznamnějším formám svobodného projevu každého jednotlivce, přičemž svým dosahem zasahuje nejen do sféry práv politických, ale rovněž práv osobních.Práci budu členit do čtyř širších částí, kdy postupně rozeberu historický vývoj právního zakotvení shromažďovacího práva na našem území od vzniku samostatné ČSR a právní zakotvení předmětného práva v nadstátních pramenech české ústavnosti, abych se následně podrobně zaměřila na analýzu recentního zakotvení shromažďovacího práva na našem území ve světle relevantní judikatury i doktríny, a ve vhodných případech rovněž komparativně s návrhem nové úpravy shromažďovacího zákona. Analytická část pak vyvrcholí částí čtvrtou, v níž provedu podrobný rozbor několika vybraných problémů zkoumané materie, přičemž pro postižení významných problémů recentní úpravy zde zařadím i případná témata s procesní tematikou a přehled vývoje agendy práva shromažďovacího na území hlavního města Prahy v období let 2012-2015. Stěžejními právními předpisy jsou na ústavní úrovni Listina základních práv a svobod, na zákonné zákona č. 84/1990 Sb., o právu shromažďovacím. | cs |
| dc.description.abstract-translated | The presented thesis titled "Substantive law basis of the right of assembly in the Czech Republic" has set a goal to analyze, dissect and evaluate the existing legislation and draw attention to application problems. The right of assembly is, according to the author, one of the most important forms of free expression of every individual, with its reach extending not only to the sphere of political rights, but also personal rights. The work is divided into four broad sections, in which the historical development of legal inclusion of the right of assembly in our country's legal system since the establishment of independent Czechoslovakia and the legal regulation of this right in supranational sources of Czech constitutionality is being gradually analyzed, so we can then focus on the analysis of recent embedding of the right of assembly in our country in light of relevant case law and doctrine, and in appropriate cases also comparatively with the new proposal on modification of the assembly law. The analytical part will then culminate in fourth part, in which a detailed analysis of several selected issues of the matter is made, with the inclusion of the major problems of recent modifications, as well as potential topics with procedural theme and also an overview of the development of the agenda of the right of assembly in the city of Prague in the period 2012 -2015.
