dc.description.abstract-translatedThis article examines the adversarial principle in criminal proceedings, par- ticularly during the preliminary phase in the Czech Republic. The adversarial nature of criminal proceedings, while not explicitly defined, is integral to the right to a fair trial, as established by Article 6 of the European Convention on Human Rights (ECHR) and related European Court of Human Rights (ECtHR) jurisprudence. The principle ensures that both parties can present and chal- lenge evidence, promoting procedural fairness. The author highlights the tension between the adversarial nature and the investigative nature of preliminary proceedings, where efficiency and confidentiality often limit full adversarial participation. The issue is particularly evident in witness examinations and the subsequent reading of their statements in court, a practice that, in the case of a witness examination as an urgent and non-repeatable act, have been repeatedly criticized by ECtHR rulings for violating the fair trial principle. To address these concerns, the article analyzes Czech legal provisions and ECtHR’s “three-step test” for assessing the admissibility of such evidence. It suggests improvements, including mandatory audiovisual recording of witness statements and appointing an ad hoc attorney during witness examinations, to balance efficiency with the protection of defendants’ rights. In conclusion, while the pre-trial proceedings cannot fully uphold the adversarial nature of the criminal proceedings, the proposed reforms could enhance fairness and align Czech practice with modern human rights standards.en
