dc.description.abstractDiplomová práce se zabývá definicí pojmu "soud či tribunál" ve smyslu článku 267 SFEU a judikovanou definicí Soudním dvorem EU. Tato práce nastiňuje názor na otázku, zda rozhodčí soudy, rejstříkové soudy a Ústavní soud ČR budou považováni za soud ve smyslu ustanovení dotčeného článku. V závěru práce se stručně poukazuje na právní následky porušení povinnosti soudu předložit předběžnou otázku Soudnímu dvoru.cs
dc.description.abstract-translatedThis thesis deals with the definition of concept ?court or tribunal? within the meaning of the Article 267 TFEU and all of his previous articles. In this thesis I focus on selected courts which I confronted with the definition of this concept. In the final part of the thesis I treat the violation of the obligation to submit the preliminary question. The thesis is divided into two parts. The first, I briefly describe the judicial authority EU which is competent to decide the preliminary question, then history of the Article 267 TFEU and some criterias of the concept of a court of a Member State EU, created by the Court of Justice. The second part focuses on the Czech courts to conform the concept "court of a Member State EU" and I try to answer the question whether selected Czech judicial authorities are or not within the concept of the definition set out in the first part of the thesis. At the end of the second part, I devote to the problem, if the court which is obliged within the meaning of the Article 267 (3) TFEU to ask the question to the Court of Justice, does not request to decide the preliminary question. On this issue, I briefly looked at from the perspective of EU law, as well as Czech law.en
