Formation and Transformation of the Employment Contract in the Historical Development of Czech Labor Law until the End of the 1980s

Abstract

The employment contract is the most typical legal fact and a key institution of labor law that leads to the creation of an employment relationship, the main purpose of which is to enable the involvement of individuals in work. For this reason, it can be said that the legal regulation and case law of the courts relating to the essentials of an employment contract will always be a relevant and discussed topic, especially given its importance in everyday lives of many citizens as employees or employers. An employment contract is the most common way of establishing an employment relationship, which means that most working individuals will encounter it several times during their lives. This fact emphasizes its fundamental importance. The aim of this paper is to offer the reader a comprehensive overview of the development of employment contracts in Czech labor law, especially their formation and changes in the historical context from the beginings to the end of the 20th century. When creating the paper, the authors drew on professional monographs, scholarly articles, and case law dealing with this issue.

Pracovní smlouva je nejtypičtější právní skutečností a klíčovým institutem pracovního práva, která vede ke vzniku pracovního poměru, jejíž hlavní účele je umožnit zapojení jednotlivců do pracovního života. Z tohoto důvodu lze říci, že právní úprava a judikaturní činnost soudů vztahující se náležitostem pracovní smlouvy bude vždy aktuální a diskutované téma, zejména vzhledem k jejímu významu v každodenním životě řady občanů jakožto zaměstnanců či zaměstnavatelů. Pracovní smlouva představuje nejběžnější způsob vzniku pracovního poměru, což znamená, že se s ní většina pracovně aktivních jedinců setká několikrát během svého života. Tento fakt zdůrazňuje její zásadní význam. Cílem tohoto příspěvku je nabídnout čtenáři komplexní přehled o vývoji pracovních smluv, zejména jejich utváření a proměnách v historickém kontextu od počátků až do konce 20. století. Autoři při tvorbě příspěvku čerpali z odborných monografií, vědeckých článků a judikatury, které se touto problematikou zabývají.
