dc.description.abstractPráce "Historický proces formování Rule of Law v Anglii" si klade za cíl zmapovat vývoj Rule of Law v Anglii od středověkých kořenů až po 18., respektive 19. století, v němž proslavil doktrínu Rule of Law A. V. Dicey. Autor si v praci klade čtyři otázka, ne něž hledal odpovědi. Otázky mají následující znění (1) kde hledat (v jakém období) kořeny konceptu Rule of Law? (2) jakým způsobem se pod vývoj Rule of Law podepsaly významné právní dokumenty, jako např. Magna Charta? (3) jak ovlivnilo myšlení právních teoretiků a politických myslitelů formování Rule of Law? (4) Rule of Law a doktrína parlamentní suverenity (ne)slučitelné principy anglického konstitualismu? Tyto otázky ve své podstatě přibližují i obsah práce.cs
dc.description.abstract-translatedThis bachelor thesis called "The historical process of the formation of the Rule of Law in England" deals with the creation of the Rule of Law in England. The main goal is to map its development from the medieval roots to the 19th century. The Rule of Law doctrine was popularized by jurist A. V. Dicey. First chapter of this thesis describes the medieval roots of the Rule of Law and discusses the works and thoughts of legal theorists Glanville, Bracton, Fortescue. Second part focuses on Edward Coke, a famous jurist. There is a description of his way of thinking and postulates. Next chapter deals with the England in the 17th century the English Civil War in 40s and the 1688 Glorious Revolution. A very important chapter of this work concerns the relationship between the Rule of Law and the Parliamentary Sovereignty. In conclusion, there is a last chapter about the Rule of Law and the Parliamentary Sovereignty according to A.V. Dicey.en
