Posthumanism, Object‑Oriented Ontology, and Legal Theory: How can We Create a Decent Milieu?

dc.description.abstract-translatedThis conference paper argues that we should consider the human person as a creature embedded in a social-political-legal milieu and that the human per- son is not a social animal, but an animal of a living milieu. The Enlightenment project of placing the human person at the center of all things may have been beneficial for some time; however, as the world stands as of today, this world view has become a burden. Therefore, it would be much better to de-centralize the human person in the system. We can better protect the human as we distance ourselves from the anthropocentric approach. For this reason, we need a relatively holistic approach to life. I believe that one recent philosophy that can help us to define and improve such an approach is post-humanism. This proposed approach may also benefit from the recent studies on Object- -Oriented-Ontology. From this ontological perspective, which is also known as flat ontology, the human person, as any other entity, is an object. The paper then proposes that posthumanism drawing on object-oriented ontology may help define a melioristic ethical perspective, which can be considered an in-between approach and would reject both the high optimism of the Kantian approach and the pessimism of political and legal realism. The paper con- cludes that legislators and lawmakers would better act in a way to sustain and promote the milieu where the human persons habituate, rather than accepting the human person as the measure of all legal endeavors and legal processes.en
