dc.description.abstractTématem této diplomové práce je právní institut tzv. opatření obecné povahy. Práce vychází zejména z obecné a zvláštní právní úpravy, judikatury a také z doktrinálních výkladů, přičemž poukazuje na různá specifika a úskalí tohoto institutu. Úvodní část je věnována základní charakteristice veřejné správy a jednotlivým formám správní činnosti, mezi něž opatření obecné povahy patří. Další části této práce jsou zaměřeny na samotnou analýzu právní úpravy institutu opatření obecné povahy. Prvně je pozornost věnována vymezení pojmu opatření obecné povahy a následně procesu jeho tvorby. Opomenuta není ani problematika konkrétních možností přezkumu opatření obecné povahy. V závěru se tato práce zabývá uplatněním opatření obecné povahy v praxi českých právních předpisů.cs
dc.description.abstract-translatedThe theme of this diploma thesis is "measures of a general nature". The work is based on general and special legal regulations as well as case law and doctrinal interpretation, pointing out different specifics and the difficulties of this institute. The introductory part is devoted to the basic characteristics of public administration and to the individual forms of administrative activity, to which "measures of a general nature" belong. Other parts of this thesis are focused on the analysis of the legal regulation of the institute of "measures of a general nature". First, attention is paid to defining the concept of "measures of a general nature" and then to the process of their creation. The issue of concrete possibilities for reviewing "measures of a general nature" is also included. The final part of this thesis deals with the application of "measures of a general nature" in the practice of Czech legislation.en
