Půl tisíce let právní úpravy držení zbraní na našem území

Abstract

Příspěvek popisuje více než půl tisíciletí právního vývoje úpravy držení a nošení zbraní na našem území, a to od prvních pokusů o regulaci ve 12. století přes vydání Zřízení o ručnicích v roce 1524, císařského patentu č. 223/1852 ř. z. včetně poválečného vývoje až po vydání zákona č. 90/2024 Sb., o zbraních a střelivu, který nabude účinnosti dne 1. 1. 2026. V této souvislosti článek zmiňuje i implementaci práva na obranu se zbraní do ústavního pořádku České republiky. Dále je v článku uvedeno několik poznámek o právu držet zbraň ve vybraných zemích Evropské unie. Konečně pak příspěvek zmiňuje některé tragické případy, na jejichž základě se rozpoutala diskuse o tom, do jaké míry zbraně regulovat či naopak jejich držení připustit.

The article traces more than half a millennium of legal development concerning the regulation of the possession and carrying of firearms in the territory of the Czech lands. It follows this evolution from the earliest attempts at regulation in the 12th century, through the promulgation of the Ordinance on Firearms in 1524, the Imperial Patent No. 223/1852 Coll., and the post-war developments, up to the adoption of Act No. 90/2024 Coll., on Firearms and Ammunition, which is set to enter into force on 1st January 2026. In this context, the article also discusses the incorporation of the right to armed selfdefence into the constitutional order of the Czech Republic. In addition, it provides several observations of the right to keep and bear arms in selected European Union member states. Finally, the article refers to several tragic incidents that have given rise to public debate on the extent to which firearms should be regulated or, conversely, permitted.
