dc.description.abstractPráce je věnována tématu franchisingu a právním otázkám s ním spojeným. Autor podává výklad o problematice definičního vymezení franchisingu a dalších pojmů, jejichž představení je nutné k podání uceleného výkladu o problematice. V práci je rovněž představen historický vývoj franchisingu jako právního institutu a prameny současné právní úpravy. Dále se autor věnuje charakteristice institutu a jeho začlenění v právním systému. Rozsáhlá část výkladu je věnována franchisingové smlouvě, jakožto právnímu základu franchisingu, a problematice s ní spojené. Práce je zakončena zhodnocením vlivu evropského práva na otázky franchisingu, zejména pak s ohledem na regulaci pravidel hospodářské soutěže. Cílem práce je podat ucelený výklad o franchisingu z právního pohledu a vymezit základní prvky, jež franchising charakterizují.cs
dc.description.abstract-translatedThis thesis is devoted to the topic of franchising and legal issues related to it. The author gives an explanation of the problem of franchising's definition and other terms, the introduction of which is necessary to provide a comprehensive interpretation of the issue. The historical development of franchising as a legal institute and the sources of the current legal regulation are presented in the thesis as well. Furthermore, the author discusses the characteristics of the institute and its integration in the legal system. An extensive part of the interpretation is devoted to the franchise agreement, as the legal basis of franchising, and the issues related to it. The thesis concludes with an assessment of the impact of European law on franchising issues, especially with regard to the regulation of competition rules. The aim of the thesis is to provide a comprehensive interpretation of franchising from a legal perspective and to define the basic elements that characterize franchising.en
