dc.description.abstract-translatedThe merits of the issue under discussion are the possibilities of protection of unrelated creditor of a trading company in times of its crisis. Close creditors‘ payments are reclassified as payments in lieu of own funds, which cannot be returned to close creditors during the company‘s crisis (in order to avoid unjustified favouritism). A preference for the position of unrelated creditors may also be envisaged in the case of the provision of a performance in substitution for own funds. In such a case, it is possible to seek satisfaction of the claim directly from the debtor out of the collateral, without it being necessary to call on the company itself to provide the performance in the first place. We conclude this article with a number of proposals for de lege ferenda legislation.en
